By booking, scheduling, or using our services—or by providing your mobile phone number to receive text messages—you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you may not use our services.

2. Age Requirement

You must be at least 18 years of age to use our services. By agreeing to these Terms, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into this binding agreement. If you are under 18, you may not book services, provide your mobile phone number, or engage with our SMS program.

4. Service Area

Our primary service area is Santa Clara County, California, including San Jose, Sunnyvale, Santa Clara, Mountain View, Palo Alto, Milpitas, Cupertino, Campbell, Los Gatos, Saratoga, and surrounding communities. We reserve the right to decline service requests outside our standard service area or to charge additional fees for extended travel.

5. SMS and Text Messaging Terms

5.1 SMS Program Description

When you provide your mobile phone number and consent to receive text messages from Stars Junk Removal, you’re enrolling in our SMS notification and marketing program. This service is designed to keep you informed and make scheduling easier.

5.5 Opt-Out Instructions

You can stop receiving messages at any time. We respect your communication preferences and make it easy to opt out:

  • You’ll immediately receive a confirmation message that you’ve been unsubscribed

  • Technical issues beyond our control

Supported Carriers: Our SMS program works with all major U.S. wireless carriers, including AT&T, Verizon Wireless, T-Mobile, Sprint, Boost Mobile, Cricket Wireless, MetroPCS, U.S. Cellular, Virgin Mobile, and most regional carriers. If you change carriers or phone numbers, you may need to re-enroll in our SMS program.

6. Booking and Scheduling

6.1 Estimates

All estimates provided by phone, email, text, or online are approximate and based on the information you provide. Final pricing is determined on-site after our crew inspects the actual items and volume to be removed. We pride ourselves on transparent pricing with no hidden fees.

6.2 Scheduling

Service appointments are scheduled based on availability. While we offer same-day service when possible throughout Santa Clara County, we cannot guarantee specific arrival times. We will provide you with an estimated arrival window and keep you updated via your preferred communication method.

6.3 Access Requirements

You are responsible for ensuring our crew has clear and safe access to all items to be removed. This includes unlocking gates, clearing pathways, and ensuring parking is available for our truck near your San Jose, Sunnyvale, or other Santa Clara County location.

7. Pricing and Payment

7.1 Pricing Structure

Our pricing is based on a fair, flat-rate structure determined by the volume and type of items being removed. Pricing factors include:

  • Volume of items (typically measured in truckload fractions: 1/8, 1/4, 1/3, 1/2, 3/4, full truck)
  • Type and weight of materials
  • Labor required for removal
  • Disposal and recycling fees
  • Location and accessibility within Santa Clara County

7.2 Final Price Determination

The final price is determined on-site before work begins. Our crew will show you the items loaded into the truck and confirm the price with you. You have the right to decline service if you do not agree with the final price—no questions asked.

7.3 Payment Terms

Payment is due immediately upon completion of service. We accept the following payment methods:

  • Cash
  • Credit cards (Visa, MasterCard, American Express, Discover)
  • Debit cards
  • Digital payment methods (as available)

Payment receipts can be provided via text message, email, or printed copy.

7.4 Minimum Charges

A minimum charge may apply for all service calls, even if you decide not to proceed with removal after our arrival.

8. Cancellation Policy

8.1 No Cancellation After Service Begins

Once our crew has begun loading items, the service cannot be cancelled, and full payment is due for work completed.

8.2 Cancellation Before Arrival

If you need to cancel your appointment, please contact us as soon as possible. While we do not charge cancellation fees for advance notice, we appreciate at least 24 hours’ notice when possible. You can cancel by phone, text, or email.

8.3 No-Show Policy

If you are not present at the scheduled appointment time or fail to provide access to the property, we reserve the right to charge a service call fee.

9. Items We Do Not Accept

For safety, legal, and environmental reasons, we DO NOT remove or accept the following hazardous materials:

  • Asbestos or asbestos-containing materials
  • Chemical waste or toxic substances
  • Paint (wet), solvents, or oil-based products
  • Pesticides, herbicides, or fertilizers
  • Batteries (car batteries, lithium batteries)
  • Propane tanks or compressed gas cylinders
  • Medical waste or biohazardous materials
  • Radioactive materials
  • Explosives, ammunition, or firearms
  • Contaminated soil
  • Industrial waste requiring special permits
  • Any materials classified as hazardous waste under federal, state, or local California regulations

9.1 Customer Responsibility

You are responsible for accurately disclosing all items to be removed. If hazardous materials are discovered on-site, we reserve the right to refuse removal and may charge for the service call.

9.2 Disposal of Hazardous Materials

For hazardous waste disposal in Santa Clara County, please contact the Household Hazardous Waste Program at (408) 299-7300 or visit a local waste management authority or licensed hazardous waste disposal company.

10. Customer Responsibilities

10.1 Property Access and Safety

You agree to:

  • Provide safe and clear access to all items
  • Identify and point out all items to be removed
  • Inform us of any potential hazards (structural damage, pests, mold, etc.)
  • Ensure pets are secured away from work areas
  • Verify that you have the legal right to dispose of all items

10.2 Ownership and Authorization

You represent and warrant that:

  • You own or have authorization to dispose of all items
  • No items are subject to liens, claims, or third-party ownership
  • You have disclosed all relevant information about the items and property
  • You are at least 18 years of age

10.3 Tenant and Rental Properties

If you are a tenant, you confirm that you have obtained all necessary permissions from the property owner or landlord to have items removed from the premises.

11. Liability and Insurance

11.1 Our Insurance

Stars Junk Removal maintains general liability insurance. We take reasonable care to prevent damage to your property during service, whether we’re working in a historic San Jose neighborhood or a modern Sunnyvale office park.

11.2 Limitation of Liability

Our liability is limited to direct damages caused by our negligence. We are not liable for:

  • Pre-existing damage to property or items
  • Damage to items with undisclosed fragility or special requirements
  • Damage resulting from structural defects or hidden conditions
  • Damage to landscaping, driveways, or pathways caused by normal use during service
  • Loss or damage to items you did not specifically identify for removal
  • Consequential, incidental, or indirect damages
  • Items mistakenly removed if not clearly identified

11.3 Valuable Items

We are not responsible for valuable items (jewelry, cash, documents, collectibles, etc.) unless specifically disclosed and agreed upon in writing. Please remove all valuables before our arrival.

11.4 Claims Process

Any claims for damage must be reported within 48 hours of service completion. Claims must be submitted in writing with photographic evidence and will be evaluated on a case-by-case basis.

11.5 Maximum Liability

Our total liability for any claim shall not exceed the amount paid for the specific service in question.

12. Environmental Commitment

We’re proud to serve the environmentally conscious Santa Clara County community. We are committed to responsible disposal practices and make every effort to:

  • Donate usable items to local charities and organizations like Goodwill Silicon Valley and The Salvation Army
  • Recycle materials whenever possible at local facilities
  • Dispose of waste at licensed and permitted facilities
  • Comply with all federal, state, and local California environmental regulations

However, we make no guarantees regarding the final disposition of specific items and are not responsible for tracking items after disposal or donation.

13. Intellectual Property

All content on our website, marketing materials, and communications, including logos, trademarks, text, images, and graphics, are the property of Stars Zen, LLC and protected by copyright and trademark laws. You may not use, reproduce, or distribute our intellectual property without written permission.

14. Privacy and Data Collection

We collect and use personal information (name, address, phone number, email, payment information, text message interactions) solely for the purpose of providing our services and communicating with you. We do not sell or share your personal information with third parties except as required for payment processing, SMS delivery, or legal compliance.

15. Dispute Resolution

15.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.

15.2 Jurisdiction

Any legal action or proceeding arising out of or relating to these Terms or our services shall be brought exclusively in the courts located in Santa Clara County, California.

15.3 Informal Resolution

Before filing any legal claim, you agree to first contact us to attempt to resolve the dispute informally. Please send written notice to our address or email listed above. We’re committed to working with you to find a fair solution.

15.4 Mediation

If informal resolution is unsuccessful, both parties agree to attempt to resolve the dispute through mediation before pursuing litigation.

16. Indemnification

You agree to indemnify, defend, and hold harmless Stars Zen, LLC, its officers, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising out of or related to:

  • Your violation of these Terms
  • Your violation of any law or regulation
  • Your violation of any third-party rights
  • Misrepresentation of ownership or authorization
  • Hazardous materials not disclosed
  • Fraudulent or unauthorized use of our SMS program

17. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Stars Junk Removal regarding our services and supersede all prior agreements, understandings, and representations.

19. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to our website at www.starsjunk.com. Your continued use of our services or SMS program after changes are posted constitutes acceptance of the modified Terms. We encourage you to review these Terms periodically.

20. Waiver
